How to File a Complaint Against an Insurance Company in India: IRDAI and Insurance Ombudsman

Step 1: Complain to the Insurer's Grievance Cell

The first step is always to raise the complaint with the insurance company itself. Every insurer is required to have a grievance redressal mechanism and a grievance redressal officer. Submit your complaint in writing, keep a copy, and note the reference or token number the insurer gives you. Set out the policy number, the facts and what you want, whether that is payment of the claim, reconsideration or a refund.

Give the insurer a fair chance to respond. If the company rejects the complaint, fails to resolve it to your satisfaction, or does not reply within a reasonable period, you can escalate.


Step 2: Escalate to IRDAI Through Bima Bharosa

If the insurer does not resolve the matter, you can approach the Insurance Regulatory and Development Authority of India through its grievance portal, Bima Bharosa, which replaced the earlier Integrated Grievance Management System. You can register a complaint online at the Bima Bharosa portal, send an email to the IRDAI grievance address, or call the toll free helpline numbers 155255 and 1800 4254 732.

The Bima Bharosa channel is open to all and there is no limit on the claim amount for registering a grievance there. The portal forwards the complaint to the insurer and tracks its resolution. Step 3: Approach the Insurance Ombudsman

The Insurance Ombudsman operates under the Insurance Ombudsman Rules, 2017, through a network of ombudsman offices across the country. The service is free, and the ombudsman can pass an award that is binding on the insurer. To be eligible, you must first have approached your insurer and either had the complaint rejected, not resolved to your satisfaction, or not answered within thirty days.

You can file the ombudsman complaint in writing, and it should set out the policy details, the insurer's response and the relief you seek. The ombudsman may try conciliation first and, failing that, issue an award.


The Rs 50 Lakh Limit and Timelines

The Insurance Ombudsman can entertain complaints where the value of the claim, including expenses, is within fifty lakh rupees. This ceiling was raised from an earlier limit of thirty lakh rupees through an amendment to the rules in late 2023, expanding the reach of the ombudsman to larger personal claims.

There is a time limit for approaching the ombudsman. The complaint must generally be filed within one year from the date of the insurer's rejection, or from the expiry of the period the insurer had to respond. Filing promptly protects your right to this remedy.


Other Remedies: Consumer Commission and Courts

The grievance system does not take away your other rights.
